No, there is no form to fill out. Just write a letter with all the pertinent information (Alien #, etc) to identify your case. Include a copy of the approved I-140 with the letter.

Hi,

If I enter using H1-B/L1visa then I-94 validity end date will be ususally till the visa expiration date.

Suppose if I am entering US on Advanced Parole(I-131), what will be the validity enddate for I-94? If suppose they give for 1 year how to extend that if i am not going out-off US?

can someone pls help me with a few question on re entry permit. i will be going back to us after 1year 8months. i had applied for re entry perit in oct 2007 - i left us in may 2008 - my re entry permit is valid till july 2010. i will be going to us in feb 2010. my question is will i have problem because i left us before i got my permit. my husband who was still in us got my permit for me.

I have state board nursing license (RN NcLex) from NJ.

A friend of mine told me that we do not have to pay Social Security Tax while working on EAD. Does anybody know if this is true ?

That would be a huge plus in case its true.

Your friend may have confused 485 based EAD with F1 OPT based EAD. On F1, you do not pay SS or Medicare. On AOS based EAD, you do need to pay SS/Medicare taxes.

In Aug 2008 I left my L1 sponsor and started working on EAD for different employer( used AC21 portability)

Now my question is can my employer apply for H1B visa for me in April 2010?

i transferred from one dept to another. the next dept filed for a H1B amend after 4 months. The lawyers filled in my G325 with the earlier, start date (and not the later filing date).

You do NOT need to have an H4 visa stamped for change of status to H1, as long as you have a valid I-94. Don't worry.

My and My Spouse I-485 & FP, EAD and AP all checks cleared yesterday and I found the Receipt Number on Back of the Cleared Checks. But when I check the status on the USCIS System. It says check the receipt Number. Is any one face this type of problem....? Please advice. Thank you.

Transit Visa is Not Required in Frankfurt. Infact I had renewed passport with all pages blank. At the transit one officer asked me On what Visa are you travelling to US?
I said I have Advance Parole.That's all. The Officers are nice and friendly. They know it.

Infact I visited German Consulate at BOSTON before travelling. The Consulate General was extreemly good and told me "Not to waste money on transit visa"

You are not subject to the cap. As you spent more than a year outside the US , you have the option of resetting your H1B clock (in other words ,apply for a H1 which would be valid for 6 years ,but would also be subject o the cap) or reviving your old H1B which would not be subject to the cap.

If you need a reference ,PLease refer to the AC21 provisions.


I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.

Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.



I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.


I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.

Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

Just hold on to those papers and make them available when they travel back in future.
Their Visa will not get cancelled, i have seen people coming back second time after just rejection. But ensure they leave the country ASAP
