Hi Experts,
My GC finally recently got approved and have following questions:
• If I don’t work for my current employer for at least six months after the approval, what kind of issues comes up when applying for citizenship later. What is the law.
• Do we have to submit six months paystubs or yearly W2s.
All I am just trying to get a knowledge on this.

As of June 19, 2009, approximately 44,500 H-1B (http://www.h1b.biz/lawyer-attorney-1137085) cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. Australian Immigration Minister Chris Evans announced recently a new agreement between Australia and New Zealand to improve identity checks and border security. Australia and New Zealand recently signed a memorandum of understanding [MoU] to share biometric data, an agreement that will further strengthen our nations' border security. Biometrics is widely used in the international community as an effective tool to manage visa and immigration processes, improve identity management and combat fraud.
At the Five Countries Conference (FCC) in London a memorandum of understanding was signed between Australia and New Zealand. The Conference enables Five data sharing Countries to exchange information and agree a way forward to improve border security. FCC data-sharing helps to establish the true identity of people whose identities or nationalities were previously unknown or uncertain, and has been used in Australia to check the identities of irregular maritime arrivals, other people in immigration detention and illegal foreign fishers. Since 2006, more than 100 000 fingerprint records have been exchanged, helping Australia and FCC partner countries to establish the true identities and immigration histories of people whose identities were unknown or uncertain. Collection and sharing of biometric data is a proven tool in the fight against identity fraud and can prevent unlawful entrants' efforts to thwart Australia's border and visa processes.

Hi ,
Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

Can you please explain it a bit more clear. I assume that you appled two I485? One for you, with your wife as dependant. And your wife, with you as dependant. Is that right.
If so which applications should have same A number. I though A number is different for each applicant. And how can your wife and you both have same A number?

Hi ,
I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.
