It is sad to see nobody coming forward for help. It is everybody's fight. When someone takes initiative we should all help. There is nothing to fear while meeting lawmakers.

Guys,
Making all EB visas current was not the right decision in the first place. That will just shift the backlog from one side to another. The only good thing was interim EAD and AP. When the visa bulletin will come out in mid Sep for FY2008 it will not be too bad provided they have already adjucated 60,000 cases in Jun and would be willing to accept more cases. The dates had already moved quite ahead in Jun 07. In Oct it may turnout to be "C" for some categories and show significant movement for others.
I hope we can still use our current medicals provided it is no later than on yr. we may have to sign the documents again with new sign date.
I am devastated myself but thats all we can do at this point. i really dont think lawsuit will do any good. uscis knows what they were doing. Though all this may help in creating a momentum for CIR, Skill Bill once again.

My salary in 2011 has been raised by $20K per annum, from what it was in 2010.
Will this have any consequences on my next H-1B renewal OR if i go for visa stamping OR on the PERM application?
Mine is a small company with just 12 employees and I hold the same position as I used to when i sarted. I just want to know if there would be any issues with this on any stages.

I think those bills will only be related to toughening border security n patrol..

But if we have a coordinated campaign to target the senators with letters/web faxes...who know we might be able to get some interim relief as part of the border security bills.
We should atleast try to recapture the visa's lost since 2000.
I for one am sending letters to both my senators. I read in one of the posts that sending letters via snail mail is ideal, along with basic info about your I140.
There is an excellent template of such letter in one of the media campaign thread.

I am a derived applicant in my green card process and recently I converted to EAD status from H1B.
My sister is US citizen. I would like to know if I am eligible to file another set of green card application thru family based option that is available. I know its a long queue.
I want to know if I am eligible for this process.
If I am eligible to file, am I eligible to file EAD thru that application as well.

They don't update the online status often..some time years ..i talked to IO regarding this issue..they said, they don't have enough resources ...I also suggested to make them the "Online Status Check" to "Offline Status Check " ..No worry..Lets all take oath, not to check this online...I don't do it..

Remember to point it out at FP, and they will also ask you to phone USCIS and correct it. You could phone USCIS first, and then you might find that FP has it already corrected in the computer.
Once USCIS update it they will send you a letter to say that they made a change to the file, this is just FYI.
My wife's DoB had a typo. It was spotted at FP office.
Of course I am assuming some obvious typo, not a FP notice for Jim Smith and your name is Ramkrishnan Singh. :-)

I heard that it is pretty easy there. 2 years back One of my friend got 10 year multiple entry visa from singapore. He has told me that there was no queue in american consulate in Singapore.

Guys/Gals,
Do you know that if i become a named Plaintiff in 485 fiasco lawsuit and the lawsuit drags for a Year ( just vague timeline) does that imapairs my ability to file a fresh new 485 application if my PD becomes CURRENT ?
I'm also assuming that USCIS would not return my Package sent on July 2nd since i'm the middle of a live lawsuit as a plaintiff.
Thoughts ? Knowledges ?

I am on H1B visa. My visa expires in April 2010. I was arrested in New York for a misdemeanor charge which was subsequently dismissed by the court. There was no guilty plea etc so under immigration law too I DO NOT have a conviction. I have all the final court docs. I am travelling to India to renew my H1B visa. I have a few questions -
(i) Is there a possibility that I am selected for 221 g screening? How long does the 221 g screen take?
(ii) Since I have a valid visa am I allowed to enter the US while they are completing the process? I have left the country before and entered on my current visa. I was sent for additional screening at the airport but had no issues since I have all the court documents.
Any insights would be appreciated

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)

The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"
Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".
My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

It is 90 days without employment on OPT. 10 days of unemployment between two jobs does not count towards the limit. You can also work part-time (20 hrs/week) or as a volunteer to stop the counter.
I recommend contacting your international department for details. They should be able to guide you depending on how useful/active they are!

I am currently working on EAD, having invoked AC21 once in the past. My labor was filed in 2005 under EB3 (I was eligible for EB2, but my company filed it under EB3, as per their policy). I filed 485 during July 2007 fiasco and am currently working on EAD.
My job qualifies for EB1 now and few of my peers have got Green Card under EB1. Can I port my filing from EB3 to EB1? Would it be better to do it with current employer or with a new employer? Pl. advice.
