I'm in the same boat...765 checks not cashed yet, rest got cashed on 9/20 and got the receipt numbers for 485/AP.
But still waiting on 765(EAD) cehcks to be cashed and receipt number.

I tried to find the thread posted by PAPPU on ability to pay. Could some one help me with this?
PAPPU:long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?
Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

It depends. If the University was never accredited by a recognized accreditation board, then USCIS would never have accepted that degree. If it was accredited before being shut down, then you might stand a chance. But if as someone has posted the university never had a .edu domain, then I doubt it was accredited by a recognized board at all.

So in this case, the person should send the documents from India, correct? One of the requirement was I-94 card. How will we provide that if you are out of the country? What to say for Last Entry?

IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.
Any inputs will be well appreciated.

I am applying 485 for me and my wife.My wife got H1 in Oct 2006 but she didnt work until now So she dont have any paystubs.So my attroney suggested to do it on H4 but her H1 is to be collapsed for that she is planning to go canada (not for stamping)and come back so that her H 1 will be collapsed and H4 will be there.I came to know from my friends that canada people are not givng any I 94 for visitors who travle by road.If we request for I 94 they are asking to keep the same I 94 which we have in our respective document.I just want to know how to get the new I 94 for her?
And also Please suggest If there is any way to apply for 485 without cancelling her H1.

ask to see if ur company can support the original GC application also. If they will provide you documentation that you mention in the 3rd point you should be fine.
Your company attorney's should be able to guide you more.
I think this is no different that using an EAD to switch jobs. You can continue working on H1B also - provided your company sees no need to file amended H1B .
