The U.S. House of Representatives concurred today with the Senate Amendment to H.R. 5116, America COMPETES Reauthorization Act of 2010 by a bipartisan vote of 228 to 130.
The bill aims to maintain national economic and scientific leadership by: supporting basic research; improving science, technology, engineering, and math (STEM) education; and fostering innovation, especially the development of new energy technologies.

For us it took @ 104 days to get AP approved.

Still i am wating on EAD,EAD was applied same time.We had RFE on June 22 resubmitted now system showing June 25 receipt date.

Guys,
After a long time I am logging into IV board. It was difficult period. Moved from TX to VA During January start. It took long to get me a good "matching" job and had to move on EAD. Sent the "proof of employment letter" to lawyer for AC21 notification.

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

Watch for April VISA BULLETIN, The DOS publishes this ususally sometime in first 2 weeks of each month for the following month. If the Date moves forward you should be able to file sometime in April, assuming the Date moves forward. Also you can use this time to prepare the application.

In the US, attorney ethics rules vary somewhat from state to state. In most states, you are clearly entitled to all substantive materials contained in your case file. Unless the retainer/fee agreement clearly obligates you to pay for copying costs in this circumstance, the law firm should give you the documents you want without charge.

I have applied I485 when i was in India and it is in pending now.I am back from India and currently in USA now and came to know that one cannot file I485 when the applicant is not in USA.
Should i be withdrawing the pending I485 and reapply now ?since there is a date availability till august 17th 2007
Or Can I appply new I485 without withdrawing the pending I485 .Once I get new receipt notice ,then withdrw the old pending I485?
Please suggest .Thanks in advance.

You need to be present in US at time of applying for the extension and when its approved. Said that in your case I think it would be fine to start H1B extension process after you are back. May be to be safe you can try doing it premium(if company is ready to spend extra money) as it gets done usually in less than a month.

As far as I know when I was in school getting my PhD (2003-2006) they had introduced a new rule saying that you could only get another OPT when you go for a higher degree. Example I did MS, use my OPT. If I go for higher degree like PhD I will get another OPT but if I go for another Masters I will not get an OPT since I used mine during first Masters. But please check with the rules in the school (contact the International Office and verify this).

Hello guys,
I am sending my family based I-485 on May 1. currently i am on h1b . My h1b approval (I-797A) is valid till April 15, 2009. my h1b extension is already pending with USCIS. My Question is :::----
Is there gonna be any problem with USCIS since my h1b approval already expired?? what will be my status after i filled my I-485?? Can i legally stay in US after filing family based I-485 even my h1b extension get denied.???

I traveled to Canada and back. The CBP-US stamped both my AP. Can I use the stamped AP for travel?

You have to go through the same process as a New H1B and it stamped in INDIA again and also get in touch with your new employer he should be able to give you the info you need. Their is no new form to be filled in.
