Dates are valid as of November 30, 2008. Texas is processing July 11, 2007 applications. Looks good. It means CIS finally has time to work on the deluge of applications they received in July 2007, even though the dates are not current yet. The approvals may still be far off, but at least we know that our apps are being worked upon.
They will keep the dates between July 11 to July 30 for a few months. During this period, they have not recieved much applications as most of the companies just kept the papers as USCIS announced that they will not accept the forms and reject. Most of the July fiasco applications must have been filed from August 3. If they are really working, then the dates should move to August 2007 in next month processing time.

You cannot claim a cousin on F1 status to be your dependent.
The most important point is F1 students have to file their own 1040NR and are Non resident aliens for tax purposes and cannot be dependents on Resident alients.
More over You cannot claim the tuition deduction for her because
(1) she showed proof of financial ability when joined the school.
(2) AFAIK, Tuition deduction can be made only for people either you/your spouse or your dependents
I know this because I paid tuition for my own sister and I was told that I cannot claim her as a dependent. Some CPA might say the contrary, but if you want the exact info call the IRS 800 829 1040

Hi,
I am wondering if I can sent both my and mywifes EAD applications in one envelope to USCIS or do I have to send them separately. I am not asking to save money on postal costs , as everyone knows we all spent 1000's of dollars in this GC process. I am only asking so that our(my and mywife) applications are processed together?

Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?
Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

Thanks for the reply. What I understand even there is no position for EB2 currently, EB2 can be filed for future employment.
Do you know anybody who was in the same situation and converted from EB3 to EB2.

I was overseas for a year (posted to another branch of the company, in another country, not my country of origin, for a year), just returned to US.
Would I be considered as "in US" all the time? And would I be considered to be "in US" for the time I was posted abroad?
The reason I'm asking is that given the way this is going with this legislation if if goes through, it might be better to be an "illegal" rather than legal. I see Zero talk about people in our situation (legal nomads).
Let us get to the bottom line.. is this legislation strategically really good for us? Is a "sneak" legislation better for us than a blanket amnesty which equates an illegal hedge pruner to a legal high skilled worker and makes no distinction?
Does it make more sense for us to have this legislation scuttled than face the prospect of seeing your friendly neighbourhood illegal plumber get on the gravy train while you wait and wait? (People like me would be waiting anyway even without this legislation)
I would really appreciate a strategic FAQ: What are we really fighting for here.. what are the likely compromises on the way..

My AP is pending and my H1 visa on passport has expired like 3 months back. I am on valid H1 status which is good for another 3 years till 2010. I have scheduled H1 stamping renewal interview in India. Can there be any problems in H1 visa stamping as my AP application (I131)is still pending?

Hi,
My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.

There is no grace period for stay. But any thing less then 180 of overstay is excused based upon your difficulties. But if you cross 180 days then you cannot enter US for three year. (Search for three year ban)

My fiances parents are applying for a B1/B2 Tourist visa on the basis of her 2 graduation ceremonies. We will get married in a court before her parents apply for a visa but the marriage ceremony will be between 2 graduations in US. If we also show that her parents are attending daughters wedding ceremony in US will the likelihood of them getting a visa increase? We can send a copy of marriage certificate before parents visa interview.

I have applied 485 in July 2, 2007. Note that my PD Jan 2001 - EB3 (priority dated ported) And I140 is already approved. I have done FP in Oct 2007. Received EAD and AP way back.But I saw LUD on my 485 application on Dec 14, 2007.
Does this mean any thing. Message content is not changed though.

My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?
PS- I am also an Indian citizen but i will obviously piggy back on her application since my PD is not current.
