Someone else recently got his GC approved even though his PD isn't current yet, and now categories are being mysteriously promoted. These are trying times indeed :rolleyes:

While travelling on H4, IF she gets her H1 Approval she can get the same stamped in the overseas and travel whenever even after oct 1, No issue with that.
Now on the other hand if she travels back on H4 after oct 1 which is the start date of H1 that may override the H1(Not sure consult appropriate attorney)

I am currently on the H1B 7th Year Extension with I-140 Approved stage from the existing company. My Priority date is Oct 2001 under India EB3. I will be moving to the fortune company starting from next month and they are ready to sponsor my green card with existing priority date. I got the copy of the 140 from my existing company and submitted the same to the new one.
Couple of days I read in the immigration articles that EB2 & EB3 dates for India may move little bit during the summer months starting from June. In that case, what are the options available for me for filing I-485 if my dates becomes current.
Can I request my old company to file for I-485 and move to new company on H1?? Or can I contact an attorney for filing my I-485 with my current documentation and work with new company on H1??
Any help and guidence on this is really appreciated. I want to exercise all the possible options when the dates are becoming current for me. If I want to file the green card from the new company, I need to wait for 6 - 9 months. However, they will use the old priority date for filing the Labor & 140.
Please help & guide me on this.

Sorry if I am posting this in the wrong place, wasn't exactly sure where to post.
I applied for my Certifcate of Citizenship through my US citizen father about 5 years ago, and due to that US citizen father being an ass I still don't have it.
I have decided to just go back to England. I am happy about going back now and this post isn't about finding other ways of getting my citizenship.
When I originally came to the US I intended just to visit so I came on the Visa Waiver Program, and then decided to stay and become a citizen
My query is: When I leave to go back home will I be able to leave the US with just my passport(recently renewed) and ticket? or will I have to contact the USCIS and get some kind of letter or the like?

If your processing date is current, if your PD is current, and if you are name check is cleared, they most likely be processing or processed your case.
If your processing date is current, if your PD is current, but if you are name check is not cleared, and so as per new rule, they will process your case in a month or so.
If your processing date is current, but if your PD is not current, but if you are name check is cleared, most probably they will pre-adjudicate your case. So the day your PD becomes current, you will get your GC. In this case if your NC is not cleared, you have to wait another month as long as you are above 180days of NC waiting...
If your processing date is not current, but if your PD is current, I have seen people getting GC, so I believe they must have cleared their NC. But I don't quite understand this scenario...

I am trying to find health insurance for my spouse who is in H4 visa.
Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?
BTW, I am living in NJ.

I am in sort of big dilemma. My Background:
- Single (not married)
- Currently on H1-B valid until Dec 2011.
- PD July 2007. Company A
- I140 & AOS filed concurrently in Aug 2007. Approved I140 (June 2008) & AOS pending. EAD & AP since Dec 2007.
I am currently working (full-time) for company A who started my GC process since last 3+ yrs. And lately I am realizing that my growth opportunity in terms of salary (more importantly) & career is very limited & been looking out lately. To an extent that I feel so frustrated that it has started to affect my social behavior.
Recently, couple of other employers have shown interest in me which align completely with my future goals. But, the problem is the following:
- they dont do H1-B & willing to hire me on EAD. Hopefully, AC21 should not be a problem as the prospective job will be in the same area.
- I am currently single planning to get married in a year or so. I want my spouse to have an option to be my dependent ie H4.
So, I have following questions to experts here which will help me decide what option to take:
1) Shall I go ahead with new employer & start using EAD ?
2) My GC doesn't seem to get approved for another year or so. Is it worthwhile to keep the option of my spouse being on H4 open & get myself frustrated & spoil my career in current company?

My Lawyer said the same thing. If you say the minimum requirement for a particular job is Bachelors + 5years of exp then every person hired for that position in the past should have Bachelors + 5yrs of exp.

Any one can be a self hurting fool using his/her "Individual�s God-given, unalienable rights". While in a democracy individuals worry about majority rule and popular thought.
I dont understand why Obama (a former senior lecturer in constitutional law ) refers to this country as democracy.

While the founders were fearful of democracy ( the mob rule ).

You shouldn't have any problem travelling during Labor Cert stage. LC has no bearing on your status as long as you have a valid VISA which you seem to have according to your post. Enjoy the trip!
